Terms of Use

1. Purpose

These Terms of Use govern access to and use of the website hub.v1.0.ad4health.com, which includes:

  • The client area, accessible after authentication, reserved for AD4HEALTH's clients for managing and tracking their campaigns;
  • The Forecast tool, accessible at hub.v1.0.ad4health.com/forecast, allowing users to simulate and forecast the performance of media campaigns.

Although access to the Forecast tool does not require creating an account, this service is designed and intended exclusively for professional use by AD4HEALTH's clients, its partner agencies, and its publisher partners. By using the Forecast, the user warrants that they are acting in this professional capacity. Access to and use of the website constitute full and unreserved acceptance of these Terms of Use.

2. Acceptance of the Terms of Use

Access to and use of the website constitute full and unreserved acceptance of these Terms of Use by the user.

For the client area (Hub), access to the services is conditional on the user's express acceptance of these Terms of Use: when logging in, the user must tick the box preceding the statement “I acknowledge that I have read and understood the Terms of Use and I accept them.” Access to the client area is not possible until this box has been ticked.

For the Forecast tool, which is accessible without authentication, use of the service constitutes acceptance of these Terms of Use, without any tick-box being required. Users are invited to review the Terms of Use, accessible from every page of the website, before any use.

In the event of disagreement with all or part of these Terms of Use, the user must refrain from accessing and using the relevant services.

AD4HEALTH reserves the right to amend the content of these Terms of Use at any time; any amendment will be brought to users’ attention via the website (see Article 9).

3. Access to the service

The Forecast tool is accessible free of charge and without any obligation to create an account. Your journey is nevertheless recorded using a pseudonymous identifier, or your login identifier if you are already authenticated on the Hub, under the conditions described in our Cookie Management Policy and our Privacy Policy.

The client area, for its part, requires login credentials strictly reserved for the agency's clients and partners to access tracking of their campaigns.

AD4HEALTH strives to keep the website accessible 24/7 but disclaims any liability in the event of a breakdown, network interruption, or issue with the tracking of generated revenue, or technical maintenance required for the proper operation of the service.

3.1 Loss of login credentials (client area)

In the event of a forgotten password, users of the client area may use the “Forgot password?” link available on the Hub’s login page, which allows them to reset their password by email.

If a user has lost their login identifier, they may contact AD4HEALTH using the contact details provided in Article 7 of the Privacy Policy.

The chosen password is personal and confidential: it is the user’s responsibility to take all necessary steps to keep it confidential.

AD4HEALTH implements reasonable measures to ensure the security of access to the client area, but cannot be held liable for unauthorized use resulting from disclosure of the password attributable to the user.

Users may contact AD4HEALTH at any time using the contact details provided in Article 7 of the Privacy Policy.

4. Intellectual property

The website's overall structure, graphic interface, architecture, campaign forecasting algorithms, as well as its texts, logos, and graphics, are the exclusive property of AD4HEALTH. Any reproduction, representation, modification, publication, or adaptation, in whole or in part, of any of these elements, without the prior written consent of AD4HEALTH, is strictly prohibited and constitutes infringement.

Any representation or reproduction, in whole or in part, of the website by any means whatsoever, without the express authorization of AD4HEALTH, constitutes an infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

In accordance with Article L.122-5 of the French Intellectual Property Code, any user authorized to reproduce, copy, or publish content from the website must credit the author and the source.

5. Disclaimer and limitation of liability

  • Nature of the results: the sole purpose of the Forecast tool is to provide estimates and simulations regarding the reach or potential performance of media campaigns. The results generated are calculated automatically based on statistical models, market trends, and the criteria entered by the user.
  • No warranty: these simulations are provided for purely indicative purposes. They do not, under any circumstances, constitute a guarantee of actual performance, a promise of results, or a contractual or commercial commitment on the part of AD4HEALTH. The actual performance of a campaign depends on multiple variables beyond the tool's control (market conditions, creative content, active competition, etc.).
  • Liability: the user (client, publisher partner, agency, or visitor) is solely responsible for the interpretation, conclusions, and use they make of the Forecast results, particularly with respect to their own clients or management. AD4HEALTH cannot be held liable for strategic, commercial, or financial decisions made on the basis of these simulations, nor for any direct or indirect damages arising therefrom.
  • Liability: the user (client, publisher partner, agency, or visitor) is solely responsible for the interpretation, conclusions, and use they make of the Forecast results, particularly with respect to their own clients or management. AD4HEALTH cannot be held liable for strategic, commercial, or financial decisions made on the basis of these simulations, nor for any direct or indirect damages arising therefrom.
  • Reliability of information: information published on the website is deemed reliable, but AD4HEALTH does not guarantee that it is free of errors or omissions. It is provided for general, indicative purposes only and has no contractual value; AD4HEALTH cannot be held liable for regulatory or market developments occurring after publication.
  • Technical security: AD4HEALTH cannot be held liable for damage caused by a virus or any other malicious element affecting a user’s equipment as a result of using, accessing, or downloading content from the website.

6. User obligations

When using the Hub and the Forecaster tool, users undertake to:

  • comply with these Terms of Use and applicable law, and respect the rights of third parties;
  • provide only accurate, honest, and up-to-date information, in particular when creating their account or entering criteria into the Forecast tool;
  • refrain from attempting to circumvent the security measures of the client area, or from accessing data or features they are not authorized to use;
  • refrain from using the website for unlawful purposes, or from introducing or disseminating content that is infringing, defamatory, or contrary to public order and accepted standards of decency;
  • refrain from using the website to send unsolicited messages or engage in any form of unauthorized commercial solicitation.

Users warrant the accuracy of the information associated with their user account. In the event of a breach of any of these obligations, AD4HEALTH reserves the right to suspend or terminate the access of the offending user, under the conditions set out in Article 8.

7. Data and privacy

Use of the Hub and the Forecast involves the processing of personal data under the conditions described in our Privacy Policy and our Cookie and Tracker Management Policy, accessible from every page of the website.

8. Term, termination, and cancellation

Access to the client area ends:

  • at the user’s request;
  • upon the end of the contractual relationship between AD4HEALTH and the client or the company they represent.

AD4HEALTH also reserves the right to suspend or terminate, without notice or compensation, a user’s access in the event of a serious or repeated breach of these Terms of Use.

To request closure of their access or to exercise their rights over their data (access, deletion, portability, etc.), users should contact AD4HEALTH using the methods described in Article 7 of the Privacy Policy.

The terms and retention periods applicable to data after access ends are detailed in the Privacy Policy.

9. Amendments to the Terms of Use

AD4HEALTH reserves the right to amend these Terms of Use at any time in order to adapt them to changes in the website or applicable regulations. Users are invited to review them regularly.

10. Force majeure

Ad4Health shall not be held liable for failure to perform the mission due to the occurrence of a force majeure event.

Any irresistible, unforeseeable event or circumstance beyond the control of the parties shall be considered a fortuitous event or a case of force majeure exempting liability.

11. Governing law and jurisdiction

These Terms of Use are governed by French law. In the event of a dispute relating to their interpretation or performance, the parties shall endeavor to reach an amicable resolution beforehand. Failing an amicable resolution, exclusive jurisdiction is granted to the courts within the jurisdiction of the Nanterre Court of Appeal, notwithstanding multiple defendants or third-party claims, including for emergency or summary proceedings.
